1. Agreement to terms

By accessing or using the website and services provided by Marketing Built by Aleck ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

Marketing Built by Aleck provides website design, development, hosting, search engine optimization (SEO), marketing automation, and related digital marketing services for local trade businesses including but not limited to HVAC, roofing, plumbing, and electrical contractors.

3. Subscription terms

Our services are offered on a monthly subscription basis. By subscribing, you agree to the following:

• Monthly subscription fees are billed in advance on a recurring basis
• You may cancel your subscription at any time with 30 days written notice
• Upon cancellation, your website and associated services will be deactivated at the end of the current billing period
• No refunds are provided for partial months of service
• We reserve the right to adjust pricing with 30 days advance notice

4. Website ownership and intellectual property

During an active subscription:

• You retain ownership of all content you provide (text, images, logos, business information)
• We retain ownership of the website design, code, and technical infrastructure
• You are granted a non-exclusive license to use the website for your business during the subscription period
• Custom design work created for your business may be purchased separately upon cancellation

5. Client responsibilities

You agree to:

• Provide accurate and truthful business information
• Respond to requests for content, approvals, and feedback in a timely manner
• Not use our services for any illegal, fraudulent, or harmful purposes
• Maintain valid payment information on file
• Comply with all applicable local, state, and federal laws in your marketing practices

6. SMS, MMS, and text messaging terms

By providing your phone number and submitting a form on our website, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA) to receive recurring automated SMS, MMS, and text messages from Marketing Built by Aleck at the phone number you provided. This includes but is not limited to:

• Appointment confirmations, reminders, and follow-ups
• Service updates and notifications
• Marketing and promotional messages
• Review requests and feedback solicitation
• Missed-call text-back messages

Consent is not required

Your consent to receive SMS messages is not a condition of purchasing any goods or services from Marketing Built by Aleck. You may choose not to provide your phone number and still use our services through other communication channels.

Message frequency and rates

Message frequency varies based on your interaction with our services. You may receive up to 10 messages per month. Standard message and data rates from your wireless carrier may apply. Marketing Built by Aleck is not responsible for any fees charged by your carrier.

Opt-out

You may opt out of receiving SMS messages at any time by replying any of the following keywords to any message: STOP, STOPALL, CANCEL, UNSUBSCRIBE, END, or QUIT. Upon opting out, you will receive a single confirmation message, and no further messages will be sent. Opting out of SMS does not cancel your service subscription or other communication preferences.

Rejoin instructions

If you have opted out and wish to re-subscribe to SMS messages, you may text START to the number you previously received messages from, or re-submit a form on our website with your phone number and consent checkboxes selected. You will receive a confirmation message upon re-enrollment.

Privacy of mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All information collected through our SMS program, including your phone number and opt-in data, will be used solely for the purpose of delivering the communications you have consented to receive. Messaging platform

Our SMS and MMS messages are sent through Lead Connector, a communication platform powered by Twilio's messaging infrastructure. By opting in, you acknowledge that your messages are processed through these third-party communication services in accordance with their respective terms of service and acceptable use policies.

Supported carriers

Our messaging services are supported by major US wireless carriers including but not limited to AT&T, Verizon, T-Mobile/Sprint, US Cellular, and others. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

CTIA compliance

Our SMS messaging program adheres to the CTIA (Cellular Telecommunications Industry Association) Short Code Monitoring Handbook and Messaging Principles and Best Practices guidelines. We maintain compliance with all applicable industry standards for commercial messaging.

Opt-in data protection

Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services.

7. Limitation of liability

To the maximum extent permitted by law, Marketing Built by Aleck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of our services.

Our total liability for any claim arising from our services shall not exceed the amount you paid us in the three months preceding the claim.

8. Disclaimer of warranties

Our services are provided "as is" without warranties of any kind, either express or implied. While we strive to deliver high-quality results, we do not guarantee specific outcomes such as search engine rankings, lead volumes, or revenue increases.

9. Indemnification

You agree to indemnify and hold harmless Marketing Built by Aleck, its owner, and affiliates from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your access to our services at any time if you violate these terms, fail to make timely payments, or engage in conduct that we determine to be harmful to our business or other clients.

11. Governing law

These terms are governed by the laws of the State of Alabama. Any disputes shall be resolved in the courts of Baldwin County, Alabama.

12. Changes to terms

We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
